A 35-year-old Goomeri painter has lost his bid for freedom after he allegedly choked his partner.

Boaz Herbert John Weis appeared in Gympie Magistrates Court from the dock on Monday, where he did not enter a plea and instead made an application for bail.

He faces two charges, including one of choking or strangulation (domestic violence offence).

Mr Weis had no supporters in the public gallery throughout his appearance.

First to speak was defence lawyer Chris Anderson, who told the court Mr Weis and his partner, who was the alleged victim in this situation, were both drunk at the time of the alleged choking; though he alleged the victim was more drunk than Mr Weis.

Mr Anderson said the alleged offence was at a “lower level”, and that the alleged victim was choked for less than one minute.

However, Mr Weis allegedly left marks on her neck.

Magistrate Chris Callaghan said he was “nervous” at the thought of letting Mr Weis out on bail, given his concerning history of domestic violence.

Police prosecutor Melissa Campbell agreed with Mr Callaghan and told the court of a specific incident in 2020 where Mr Weis threatened to kill his ex partner and was found with an axe in his car.

As a result, Mr Callaghan refused Mr Weis bail.

He was remanded in custody and will reappear before the court on June 27, 2022.
