A miner-turned heart attack survivor who “soaked” his neighbour with a garden hose has faced court where more about the pair’s petty running battle was revealed.

Gladstone man Luke Kevin Davey was subject to a peace and good behaviour order towards a female neighbour after she took him to court.
But the tension between the two New Auckland residents did not end there.
After the order had been made, the woman walked onto her porch one day and felt water on her back.
She turned around and saw Davey, in the front yard of the property next door, with a watering hose in his hand.
The woman said to Davey “do you want to do it again?”
Davey replied “f*** off” and he pointed the hose in the woman’s direction, spraying water over her so she was “soaked.”
Davey, 50, accepted that version of events in relation to the July 2024 incident when he pleaded guilty in Gladstone Magistrates Court last week to common assault.
The court heard Davey’s one-page criminal history was “limited” and contained property offending.
Solicitor Stephen White said Davey, a father, had a heart attack eight months ago and he was currently not working.
“He is on Centrelink payments however he is a very qualified man,” Mr White said.
“He does have his grader, dozer, loader, and dump truck operator licences and previously worked for a long time as a shotfirer in the mines.”
Mr White submitted a fine would be appropriate for this offending.
Magistrate Mary Buchanan fined Davey $800 and a conviction was recorded.
