A Central Queensland domestic violence offender who reoffended just five days after being released from custody, has been jailed.

The man in his 20s, who by law cannot be named, appeared in custody in Gladstone Magistrates Court where he pleaded guilty to contravening a domestic violence order (aggravated offence).

The court heard that on October 13, the man, while on parole for domestic violence offending, was at the aggrieved woman’s Gladstone home when he was not allowed to be there under the DVO.

Police prosecutor Kelvin Boyd said the woman’s father had to “walk the (man) outside” and he subsequently left the residence.

“Your Honour will note from his history, which is quite an extensive history – seven pages – that there are a number of domestic violence offences,” Mr Boyd said.

“He’s received terms of imprisonment (previously) for having breached the domestic violence orders.”

Mr Boyd said the man was “just not getting” the message in relation to domestic violence orders.

“The other thing of note... is that this offending occurs five days after he is released from custody for (similar) offending, which in my submission is a significant aggravating feature also,” Mr Boyd said.

The prosecutor submitted a head sentence of 12 months’ imprisonment was in range.

Solicitor Bianca Wieland said the man had entered “a very early” plea of guilty which was an indication of remorse for his offending behaviour.

Ms Wieland said the criminality of this offending was “very different” to the man’s prior offending.

“When he was told to leave (the house) he did go,” she said.

Ms Wieland submitted a suspended jail sentence could be imposed.

Magistrate Mary Buchanan did not agree with a suspended sentence.

“He’s had suspended sentences previously and they’ve been extended... they haven’t worked as a deterrent,” she said.

Ms Buchanan sentenced the man to six months’ jail, took into account 20 days’ pre-sentence custody, and fixed parole eligibility at December 23.

A conviction was recorded.
