A Lockyer Valley man accused of launching a horrific assault on a defenceless elderly man has had his case heard in a Toowoomba court.
Police allege that in March 2023 Stoney Izak Allen Graves was drinking at a pub when he was allegedly told that a 73-year-old had complained to police about Mr Graves’ driving.
In retaliation, police allege Mr Graves assaulted the elderly man.
Following the alleged assault, the man was taken to hospital with a small spine fracture, a collapsed and bleeding lung, as well as fractured and dislodged ribs.
Mr Graves, 23, had his case mentioned in Toowoomba Magistrate Court on May 10.
The court was told police prosecutions were yet to disclose a brief of evidence.
Magistrate Kay Philipson ordered the brief of evidence be disclosed to Mr Graves’ legal team by May 17 and set the case aside to be mentioned on May 18.
On the night of the offences, Mr Graves is alleged to have left the Murphy’s Creek Tavern and went to the man’s home to confront him.
During a failed bail application hearing, a Toowoomba court was told the victim had just been released from hospital and was home with his wife.
The court was told Mr Graves knocked on the older man’s door and argued with him before allegedly punching him in the head, knocking him to the ground.
The man fell on a wooden bench before Mr Graves allegedly picked it up and threw it at him, pinning him to a wall.
He tried to turn away and shield himself, but Mr Graves allegedly continued to throw punches, before throwing the man across and off the 1m high veranda, “violent enough to dislodge his hearing aids”.
The incident was captured on the victim’s security camera.
Mr Graves has been charged with one count each of grievous bodily harm, obstructing police, and separate charges of driving an uninsured vehicle, a car must not be driven or parked on a road if defective, and using an unregistered car on a road.
Mr Graves remains in police custody.
