Max William Vinson pleaded guilty to obstructing police

As police searched for a wanted person, their hunt came to a halt when a man stood in a hallway with his arms outstretched and refusing to let the officers into his home while the wanted person made his escape.

With his arms outstretched to try to prevent police from searching his home for a wanted person, a man first obstructed police and then proved difficult during his own arrest, a court has heard.

Police prosecutor Louise McConnell said on July 21 about 7.30pm, police had gone to an address in Hibiscus St in Urangan in relation to a wanted person.

Police had reasonable suspicion the person was at the address because his car was parked in the driveway and he was seen in the car earlier in the day.

Vinson answered the door and was told the officers were there for the wanted person.

He told police the person wasn’t there, Ms McConnell said.

Police entered the dwelling under the Police Powers and Responsibilities Act, Ms McConnell said, to arrest the person in regard to a warrant.

Vinson stood in the hallway with his arms outstretched, preventing police from entering.

He told them they could not come in without a search warrant.

He was informed police could enter, but Vinson continued to stand with his arms outstretched.

Vinson was arrested and the wanted person was found a short time later over the back fence in a neighbour’s yard.

The defendant started walking away and he was told he was still under arrest, Ms McConnell said.

He then started yelling “get out of my house without a warrant, I don’t even have to talk to you”, the court was told.

Vinson started walking towards the front door and was told to stop walking away from police.

Ms McConnell said after the arrest, police had needed to use extra pressure to get Vinson walking out the front door.

He was again told to keep walking as he was under arrest, but he resisted police, she said, using pressure to pull back.

Vinson was taken to the watch house and charged, she said.

Defence lawyer Virginia Ukpabi said Vinson had been under the mistaken belief that police could not enter his home.

She said his behaviour was “clearly not appropriate”.

Vinson was currently pursuing an apprenticeship as an electrician, she said.

Magistrate John Milburn said Vinson was currently on parole, but seemed to be progressing well.

Vinson was fined $900 and a conviction was recorded.
