A court has ruled a man accused of molesting his own teenage daughter can have his ankle monitor removed so long as he reports to police every day.
The 70-year-old man, who cannot be named for legal reasons, appeared before Maryborough Magistrates Court on Monday applying to vary his bail.
He has been charged with 27 counts of indecent treatment of a child under 16 and and two counts of incest.
The court heard the man’s ankle monitor had previously been activated, once when he went camping in a poor reception area and a second time when it sent a tampering alert.
That could mean someone was attempting to cut or remove the device and resulted in the man receiving a new monitoring
His defence lawyer said the monitoring device caused him pain and discomfort, particularly because his legs became swollen in the afternoon and evenings.
A letter from a doctor tendered to the court supported this, saying the man suffered from renal disease and he took blood pressure medication resulting in swollen ankles, which made it difficult to wear an ankle bracelet.
The court was told the man was not a flight risk, had surrendered his passport and he had never failed to appear before the court previously.
If the man were to be found guilty he could spend the rest of his life in prison “so the stakes are quite high for him”, the court was told,
The court heard the complainant in the matter was the man’s biological daughter.
If the ankle monitor was removed, it was suggested regular reporting would be necessary to ensure the man continued to appear before the court.
Magistrate Janelle Boegheim ruled the ankle bracelet could be removed but the man would need to report to police every day.
The matter was adjourned until May 27, 2025.
