Man pleads guilty to breaching a domestic violence order

The 39-year-old man pleaded guilty to breaching a domestic violence order when he appeared before Maryborough Magistrates Court.

Police prosecutor Sergeant Balam Selvadurai said on March 24, 2025, police were sent to a home about 5.55am.

When police arrived they separated both parties, the court heard.

The incident had started when the man woke up and saw a message on the woman’s phone, Sgt Selvadurai said.

He thought it was from another man and started accusing her of cheating.

They started arguing, which turned physical when the man pushed the woman onto the bed, the court heard.

The woman didn’t want to make any criminal complaint regarding the assault, Sgt Selvadurai said.

The man told police about seeing the message on the phone and believed she was cheating on him, Sgt Selvadurai.

There had been a verbal argument and the man went to use the toilet, the court heard.

The woman followed him into the bathroom to “continue the argument” and he “lost his cool and pushed the aggrieved out of the bathroom and onto the bed”, Sgt Selvadurai said.

The man was fined $500 and no conviction was recorded.

He made full admissions to police and was cooperative, further stating he knew the behaviour was a contravention of the order.

The court heard the man was employed full-time and had been in a relationship with the woman for several years.

The two shared two children, the court was told.

The woman was in court supporting him and she also provided a character reference.

The man had been partaking in some “unfortunate drug use” and was seeking to cease that and address his mental health issues, the court heard.

Magistrate John Milburn said the letter from the man’s partner said she regarded him as a reliable and compassionate person, and an “awesome human being”.

The relapse of mental health was now being dealt with, Mr Milburn said.

“You are a very fortunate man.”

The man was fined $500 and no conviction was recorded.
