Man in Hervey Bay court for choking, threatening to kill his mother

A Hervey Bay mother has been allegedly choked and threatened with death by her own son, after he flew into a rage.

A Hervey Bay man has been denied bail after he allegedly choked and threatened to kill his mother in a fit of rage.

Liam Michael James Valentine faced Hervey Bay Magistrates Court via video link on Thursday.

His lawyer, Daniel Ould, requested bail for Valentine to live with his sister, her partner, and their three children outside of Hervey Bay, but was met with staunch opposition from police prosecutor Lisa Fulcher.

The nature of the allegations, dating to December last year, involve Valentine “placing pressure” around the victim’s throat, telling her “you’re going to die, c***”.

This pressure allegedly caused her to stop breathing, before he said “you’re definitely going to die”.

These actions are alleged to have occurred after he was arrested and granted bail the day prior for separate alleged offending at his mother’s home on December 22, 2024, where he allegedly argued with her and broke property.

The prosecution said the victim had Huntington’s disease, which they argued made her more vulnerable to attacks like this.

Ms Fulcher told the court the victim “initially felt safe being within her home”.

“The most alarming feature for prosecutions is that the defendant has not been provoked by the victim, other than being arrested for property damage and verbal abuse the day before.”

The victim had to seek medical treatment due to the injuries to her throat.

At one point during the application, the man told Magistrate Trinity McGarvie the statements from the victim were “over exaggerated and I don’t think I’m a risk to society”.

He is charged with breaching a bail condition and choking, suffocation, and strangulation.

Ms McGarvie did not grant bail, saying there was “an unacceptable risk of further domestic violence”.

His appearance was excused for his next court mention on April 3, 2025.
