Man hit with baseball bat after refusing to leave ex-partner's home

A domestic violence order breach case has taken an unexpected turn after the perpetrator became the victim of a baseball bat attack when he wouldn't leave his ex-partner's property.

A sawmill worker who became involved in a spat with his former partner was struck with a baseball bat when he refused to leave her home, a court has heard.

The man, who cannot be named for legal reasons, pleaded guilty to three counts of breaching a domestic violence order when he appeared before Maryborough Magistrates Court this week.

Police prosecutor Sergeant Balam Selvadurai said the man had attended his former partner’s address to assist her with their children, but he had not received her consent to be there.

In relation to the second charge, the man had been asleep when the woman woke him up by pouring water on him, Sgt Selvadurai said.

The man became aggressive, calling her names including a “stupid f**king c**t” and an idiot.

He had told her to go f**k herself and said she was “nothing but a piece of s**t”, the court heard.

He then left, trying to get his daughter to go with him but she refused, Sgt Selvadurai said.

In relation to the third incident, the man was given written permission to attend the address and spend time with the children, but the two had a verbal argument and he was asked to leave, but he refused.

The woman messaged a friend asking them to come and ask the man to leave.

Six people arrived at the home and the man was hit with a small baseball bat before he left the property, Sgt Selvadurai said.

He was questioned by police in relation to the incident and told police he recalled being at the address at that time and that he had been uninvited by the aggrieved.

Duty lawyer Morgan Harris said the man had the capacity to pay a fine and was working at a Maryborough sawmill.

Magistrate Stephen Guttridge fined the man $1000 and convictions were recorded.
