Man faces court for breaching domestic violence order

The man pleaded guilty to one count of breaching a domestic violence order when he faced Maryborough Magistrates Court on Tuesday.

The court heard the man sent a series of messages to his former partner calling her a “monster” and telling her to “go f**k herself”.

She replied to him, telling him to stop messaging her.

He responded: “Go take a one-way walk off a pier”.

She again asked that he stopped messaging.

The woman made a complaint to police some days later, providing screenshots of the messages, the court heard.

The man was spoken to by police and charged.

The man had previously undertaken a 16-week Men Choosing Change program through Uniting Care and had submitted an apology letter, the court was heard.

But it was pointed out that the man had committed the offences after completing the course.

Duty lawyer Morgan Harris said the offending hadn’t been prolonged and the man was remorseful.

The texts had occurred out of frustration because of the argument they were having, Mr Harris said.

The man was employed and was a contributing member of the community, he said.

It was the first time the man had been charged with breaching the order, Mr Harris said.

Magistrate John Milburn commended the man for completing the course and said he had written an apology.

He had ongoing assistance through counselling, Mr Milburn said.

“You were frustrated, you lapsed,” he said.

But Mr Milburn said the man had been “profoundly disrespectful” to the victim.

“The language you used, the tone that you used, is not acceptable in our community,” he said.

“Courts must impose significant penalties to provide a deterrent.”

He said a fine would be appropriate in this case.

The man was fined $700.

Mr Milburn said he would not record a conviction on this occasion, but it was not to downplay the seriousness of the offending.

He said he had considered the prospects of the man’s continuing rehabilitation when deciding not to record a conviction.
