Declan Jamie Thomas Burton charged with unlawful striking causing death

A young Maryborough farmer accused of punching and killing a man outside a pub has found out what will come next in his court case.

A young dairy farmer charged with unlawful striking causing death has had his matter briefly mentioned in court.

Tinana’s Declan Jamie Thomas Burton, 20, is accused of causing the death of another man in a pub assault.

The matter was mentioned before Maryborough Magistrates Court on Monday.

Police will allege an argument began between Mr Burton and James Andrew Curtis outside the Lamington Hotel on Ferry St in Maryborough on November 24, 2023.

Mr Burton, who works at his family dairy Burton’s Milk, allegedly struck 51-year-old Mr Curtis in the head about 10pm, causing him to fall and hit his head on the pavement.

Released on bail just before Christmas, Mr Burton was initially charged with one count of grievous bodily harm but in the wake of Mr Curtis’ death in hospital on December 7, 2023, the charge was upgraded to unlawful striking causing death.

Mr Burton has not entered a plea.

The matter was adjourned until September 2024.
