Casey Leslie Charles Spencer in court for obstructing, assaulting police

A father of two who repeatedly bashed on the front door of his ex-partner’s home and demanded to be let in, later assaulted a police officer who was trying to arrest him.

Casey Leslie Charles Spencer, 42, pleaded guilty in Hervey Bay Magistrates Court to breaching a domestic violence protection order, obstructing police, breaching bail and assaulting a police officer in December 2024.

Police prosecutor Louise McConnell said the incident happened about 6.40pm on December 3, 2024.

Spencer went to the home of his former partner, bashed on the front door and demanded everyone get outside.

His ex partner spoke to him through a closed garage door and asked him to leave, Ms McConnell said.

Spencer said he wasn’t going anywhere and the police were called.

He continued to hit the front door, trying to get inside.

When police arrived, Spencer was standing in the driveway in a “fighting stance,” Ms McConnell said.

When they approached Spencer he was “immediately elevated”, asking them “what the f**k do you want?”

When told he was under arrest for contravening the protection order, Spencer immediately tried to run, throwing his hands out towards police, the court heard.

The officers drew their tasers and told Spencer to cease his actions and get on the ground.

But Spencer said no and continued to “verbally challenge police”.

When police then tried to restrain him, he threw his arms out and said “I’m not f**king going”.

More police arrived and Spencer tried to run before turning around swinging his arm towards one of the officers, and hitting them in the forehead with the palm of his hand.

He was then restrained and taken to the police station.

Spencer had also breached bail by failing to report to Hervey Bay Police Station on December 20, 2024, Ms McConnell said.

The court heard he later attended the station on December 27, 2024, he explained he had forgotten what day it was and arrived after the station had closed.

Duty lawyer Justin Geldard said Spencer had gone to the home with the intention of seeing his children and was suffering from a mental crisis at the time.

In relation to the police, Mr Geldard said Spencer had been in an agitated state and had reacted poorly.

Spencer was currently employed as a manager at a motor dealership.

He had since sought mental health support and treatment, receiving fortnightly counselling and being prescribed medications on a mental health plan.

Spencer was described as being in a “much better state” now and Mr Geldard asked the court to consider not recording convictions.

Magistrate Trinity McGarvie said Spencer’s behaviour was “threatening and intimidating” when trying to gain entry to the house against the woman’s wishes.

“That is an act of domestic violence,” she said.

“You then compounded that appalling behaviour in the way that you responded to police.”

Ms McGarvie said police “shouldn’t have to be assaulted” when carrying out their duties.

Spencer was placed on nine months' probation and convictions were recorded.
