Ernest Bradley Green in court for assault at Torquay Hotel

A man who slipped while trying to escape his pursuers outside a beachside pub was then bashed and kicked until he lost consciousness. Now one of his attackers has faced court.

A Torquay man who brutally assaulted a man in an unprovoked, alcohol-fueled attack has been sentenced today.

Ernest Bradley Green, 20, pleaded guilty to assault occasioning bodily harm at Hervey Bay District Court on Monday morning.

The court heard that at 2am on April 15, 2022, Green and seven other individuals confronted a man outside the Torquay Hotel on the Esplanade after being kicked out of the venue.

An altercation then occurred which resulted in the man fleeing into the pub‘s car park, where he slipped and was subsequently set upon by Green and his associates.

The court was shown CCTV footage of the incident, and the victim could be seen being kicked and punched repeatedly in the head and chest before losing consciousness while also having his phone smashed.

Green and two other individuals attempted to flee the scene when police arrived but were subsequently arrested - but not before refusing an interview, the court was told.

The victim who only regained consciousness when police arrived reported to Hervey Bay Hospital where he was diagnosed with numerous injuries including a haematoma, lacerations to the face, heavy bruising to the ribs and blood in his urine.

Green’s defence lawyer Wesley Sewall said his client worked part-time work on K’gari and participated in “cultural education” on the island, which was evidence of his rehabilitation in the community.

Green’s case was supported with good character references by the Butchulla Aboriginal Corporation, Joyce Bonner and his mother.

Judge William Everson labelled Green’s behaviour as “rubbish” and sentenced him to 12 months' jail with a parole release date of Monday, October 16.

Convictions were recorded.
