Kahuihonepotaka Duncan Smith Bason: Brisbane man pleads guilty to assault with piece of wood in Dalby

A recent chemotherapy patient was savagely attacked with a large piece of timber on a night out in Dalby after he asked a 21-year-old Brisbane man one question.

A Brisbane father who flogged a recent chemotherapy patient with a large plank of wood has been handed jail for his brutal assault.

Kahuihonepotaka Duncan Smith Bason was 21-years-old when he was walking along Drayton Street in Dalby on the evening of May 8, 2020, when two men asked how he was going from across the street.

Crown prosecutor Amy Stannard told the court the former aquatic centre worker replied to the two men to not come near him, as he wasn’t in a “good mood”.

Dalby District Court heard as the two men approached, the now 23-year-old grabbed a 50cm plank of wood and struck one of the men in the face, and left the scene.

The victim suffered swelling between his cheek and eye socket, as well as cuts and bruising to his jaw.

Shortly afterwards, Bason spoke to police and said it was in self defence.

Defence barrister Frank Martin said Bason saw the two men coming and felt he was going to be attacked by the victim and his friend at the time.

Mr Martin told the court the injuries weren’t “that serious”, and said Bason had apologised to his victim in the lead up to what was to be a trial, before the 23-year-old pleaded guilty on Tuesday morning.

Judge Dennis Lynch noted the victim’s impact statement, where he said he felt “less safe” walking the streets, and had been assaulted following a period of chemotherapy he had received for an illness.

His honour said however he was “impressed” by the positive changes Bason had implemented in his life since he was charged.

Bason pleaded guilty to assault occasioning bodily harm while armed and was sentenced to nine months’ jail, but given immediate parole.
