Jessica Ellen Creevey: Jandowae mother pleads guilty to serious assault, assault occasioning bodily harm in Dalby District Court

An elderly Western Downs mother and her daughter have revealed in court the shocking moment their neighbour savagely bashed them during a night of terror.

A Jandowae mother has been jailed for her savage assault on an elderly woman and her daughter during a disturbing neighbourhood dispute.

The two women gave evidence in Dalby District Court on May 25, where their attacker, Jessica Ellen Creevey, faced charges of serious assault, and assault occasioning bodily harm.

In their victim impact statements, the elderly mother and her daughter detailed the savage melee that occurred about 9pm on April 23, 2020 in Jandowae.

Both complainants recalled Creevey screaming repeatedly next door while they slept, which prompted the elderly mother to hose the defendant with water over the fence while she said “shut your mouth”.

The mother claimed Creevey vaulted the fence and jumped on her, where she was “punched to hell” by Creevey.

She told the court Creevey repeatedly struck her in the head and back, and said she “still felt those punches today”.

The court heard the daughter rushed outside, with the mother stating Creevey was “pulled off” her, before Creevey rained blows upon her daughter.

Photos tendered to the court outlined the injuries suffered by both complainants, which included bruising and swelling to the mother’s neck, head and knee, and bruising and cuts to the top of the daughter’s eye.

Criminal barrister Frank Martin suggested there were inconsistencies in both victim’s statements.

These included the credibility of the complainant’s injuries compared to their testimony, the amount of punches thrown by Creevey, the visibility of the assault, and whether Creevey jumped on her mother’s back, or pulled her down face-to-face.

Creevey took the stand where she vehemently denied savagely assaulting the pair, and stated she didn’t “stomp or bash” the mother after they wrestled with the hose, and only connected one punch to the daughter.

Judge Michael Burnett said there had been a problem of “recollection” from all parties, attributing it to the amount of time passed since the assaults.

Ultimately he accepted the statements the victim’s gave to police, as they were more consistent with evidence from medical records and photographs of their injuries.

Judge Burnett said Creevey’s version of events was affected by alcohol, as she said she had drank 1L of wine after the bashings.

He agreed that Creevey “pummeled” the mother in the head, neck, and shoulder, and that the daughter didn’t kick Creevey in the stomach.

Judge Burnett noted however that Creevey’s strikes were more “drunken swings” rather than serious hits, and that the daughter had struck Creevey in the mouth after Creevey apologised.

Crown prosecutor Alysha Ballantyne noted several instances of violence in Creevey’s criminal history, which included assaulting and spitting on a woman in 2013, spitting on a paramedic and grabbing a police officer’s hair in 2017.

Dalby District Court heard Creevey was on a suspended sentence when the 2020 assaults occurred.

Mr Martin in his final submissions said his client had made steps to rehabilitate her alcohol and drug use.

Creevey pleaded guilty and was given a head sentence of 12 months imprisonment.

Judge Burnett then activated her suspended sentence to run concurrently with her sentence.

He then set a parole release date of July 18, 2021.

Creevey said her goodbyes to her relatives in court, and was led out by Dalby police.

Convictions were recorded.
