Hayley Zelda Luland-Moore claimed tonsillitis was reason she spat at police, Dalby Magistrates Court told

A Dalby woman who spat in the direction of a police officer claimed her actions weren’t intentional after appearing in court charged with a serious offence. Here’s what she said.

A Dalby woman has claimed she was unwell and had trouble swallowing her spit, which was why she spat towards a police officer.

The Dalby Magistrates Court was told on September 19 at 11pm police officers attended Hayley Zelda Luland-Moore address for an unrelated matter when she became aggressive.

Police prosecutor Chris Hutchins said the woman started swearing at the officers.

“She told the officer, ‘shove it up your f--king arse’,” Sergeant Hutchins said.

The 27-year-old eventually submitted to a breath test where she still had built up saliva in her mouth and spat it towards the officer.

“It missed his face and landed behind him and on the steps,” Sergeant Hutchins said.

“Really it’s spitting in their direction.”

Defence lawyer Julia Molloy said her client had been suffering from tonsillitis at the time the police arrived at her home.

“She couldn’t swallow her spit and apologised straight away saying she didn’t mean to spit it towards them,” she said.

The court was told Luland-Moore committed the offences while on a one month suspended sentence for six months, and she pleaded guilty to one count of assaulting a police officer.

Magistrate Melanie Ho extended the woman’s suspended sentence by three months and fined her $500.
