A man who brandished a knife and told police to shoot him during an almost 24-hour siege at his Chinchilla home has been sentenced in court.

Chinchilla Magistrates Court was told Dylan Peter Mackinlay was already aggressive when police arrived at his house in relation to a disturbance on August 22.

Police prosecutor Chris Hutchins said officers at the scene believed the 35-year-old was preparing to launch an attack on them after he said, “You better bring everyone, there better be knives and guns”.

“He pulled out a machete and spiked it into the ground, police took this as a display of him going to use it,” Sergeant Hutchins said.

“He then put gloves on as if he wanted to protect his hands.”

The Chinchilla court heard police then retreated to the footpath and could see the man pull out a bottle of alcohol and begin to swig it, continually throwing the machete to the ground and picking it back up again.

“He said, ‘You’re going to have to shoot me, I’m ready’,” Sergeant Hutchins said.

He said that Mackinlay became increasingly aggressive towards the special emergency response team and negotiators, saying “he’d kill anyone”.

The man was put under arrest when his wife attempted to run inside and barricade the doorway to stop the man from leaving.

Police also found rifle ammunition, a bong, 15 marijuana plants and 13 seeds at the scene.

Sergeant Hutchins said there were no hostages, despite the father’s wife and children being inside the house at the time, though Mackinlay only made the situation worse for himself through his frightening actions.

Defence lawyer Brad Skuse said his client accepted his actions were inappropriate and had recently undergone a mental health examination that showed he suffered from a moderate depressive disorder.

“He was suffering already on this day as it was the anniversary of his brother’s death,” Mr Skuse said.

Mackinlay pleaded guilty to serious assault against a police officer while armed, obstructing police, producing drugs and possessing explosives with authority.

He was placed on 18 months’ probation.
