Dalby dad in Western Downs court after kicking police, abusing family during drunken outburst

A man already on probation for alcohol-related offences has faced Dalby Magistrates Court again after he assaulted police and verbally abused his family in a series of drunken and chaotic events.

Dalby police were called to an address on Sunday night after a man’s former partner and mother of his child received a string of concerning voicemail messages.

Police prosecutor Chris Hutchins said after arresting the 51-year-old and taking him to the Dalby police station, the officers attempted to talk with him before he kicked the police car door open with his feet.

“He used his feet to kick the door open then kicked (the police officer) in the chest region, narrowly missing his head and face,” Sergeant Hutchins said.

“After he got out he resisted and verbally abused officers.”

Before the dramatic arrest, the court was told the man had left a series of violent voicemails on his ex’s phone, which led to the police arriving at his home.

Some of the messages included: “I’m coming around and I’m going to cause so much f--king drama”, “You lying c--t, I’m coming round to see you” and “You can ring the police because I’m going to f--king wreck everyone there”.

Defence lawyer Julia Molloy said her client claimed he was triggered after his ex told him he wasn’t allowed to attend his daughter’s birthday.

“He was upset by that and went to the pub and had some drinks,” she said.

“He didn’t attend (his ex’s house) to collect his property, when she called him she realised he was drunk and hung up.

“Then he left the voice messages.”

The man, who has a ‘no alcohol’ condition on his probation, presented a BAC reading of 0.116 that evening.

Magistrate Kyna Morice acknowledged the man’s alcohol-abuse, and recommended he seek further counselling to help treat the concerns.

“Alcohol dependence, I understand is not a matter you can snap your fingers and get rid of it,” she said.

The Dalby man pleaded guilty to assaulting police, two counts of obstructing police, two counts of contravening a domestic violence order and one count of breaching a bail condition.

He was sentenced to 12 months’ probation.
