A magistrate has told a Western Downs drink driver he was lucky to survive coming off his motorbike while almost five times the legal limit.

A Chinchilla magistrate has told a drink driver he’s lucky to be alive after crashing a motorbike after drinking two bottles of Jack Daniels.
Dawson Charles Madeley appeared in Chinchilla Magistrates Court on Thursday and pleaded guilty to driving under the influence of alcohol and driving while unregistered, unlicensed and uninsured.
The court was told that on January 2 police were called to a crash on Banana Bridge Rd, Kogan about 7.49pm, finding Madeley at the scene.
Madeley said he had two bottles of Jack Daniels and then tried to ride to the Kogan Pub for dinner when he had come off his bike, crashing into the grass on the side of the road.
Police subjected Madeley to a breath test where returned a high range reading of 0.241, almost five times the legal limit.
Police also determined Madeley had never held a licence, his motorbike hadn’t been registered or insured since 2006 and it had cancelled number plates.
Magistrate Kathleen Payne told Madeley he was lucky to be alive and even luckier he didn’t kill someone else.
“It is most unusual that people walk away from a crash with that high of a reading on a motorcycle,” she said.
“When I was a magistrate in Ipswich I had someone come in who was in a wheelchair from drink driving.
“Either you kill someone or badly injure yourself.”
Madeley was fined $1500, received an 11-month loss of licence and no conviction was recorded.
