XXXX Brewery applies for 15-year extension of exemption from civil and criminal proceedings

The famous Milton brewery would be protected from certain civil and criminal proceedings, meaning repeated complaints will not result in a change of condition for the brewery.

MILTON’S XXXX brewery would be protected from repeated nuisance complaints under a 15 year lockdown to protect the iconic Queensland building.

The Sunday-Mail can reveal the brewery has applied for a 15 year extension of an existing exemption, that protects it from certain civil and criminal proceedings.

It means that any repeated nuisance complaints about the brewery from nearby residents and businesses does not result in a change of conditions for the brewery’s operations.

The company insists the exemptions do not override the “common law” rights of residents in existing developments.

But under the legislation, occupiers of nearby premises would still be restricted from initiating certain civil proceedings for nuisance, or criminal proceedings relating to a local law.

The affected area extends north to Heussler Tce and Haig Rd, south to Coronation Drive along the Brisbane River, west to Torwood St and Eagle Tce and east to Castlemaine St and Boomerang St.

The brewery was first protected under similar exemptions in 2009 and says the long the term renewal application shows it intends to stay in Brisbane for the “long haul”.

“We are applying for an extension to our existing registration which, over the last decade, has delivered the right balance between amenity for local residents and operating certainty for a Queensland icon that has operated in Milton since 1878,” a XXXX spokeswoman said.

“It is always our objective to be an excellent neighbour.

“In the last 10 years we have significantly reduced our already low noise and light emissions, all of which are within the limits allowed under our development consents.”

XXXX will consult with residents and local businesses through to early April about the renewal process before they lodge a formal application with the State Government.

Over the past decade, it has only received ten minor complaints about their operations, which XXXX says it dealt with “rapidly and comprehensively”.

A Planning Department spokeswoman confirmed no other businesses in Queensland are protected under the same laws.
