Daniel White-Mayne found guilty of striking to resist arrest during carpark shootout with police

A man involved in a shootout with police in a Gold Coast car park has been found guilty of the lesser charge of attempted striking to resist arrest.

A MAN involved in a shootout with police in a Gold Coast car park has been found guilty of attempted striking to resist arrest.

The crown alleged White-Mayne intended to kill the constable when he fired the shot but the jury found him not guilty of attempted murder.

The jury deliberated on alternative charges of attempted murder, attempted striking to resist arrest and resisting while armed with a dangerous weapon and ultimately decided he was guilty of the second charge of attempted striking to resist arrest.

During the trial, the court heard White-Mayne pulled a loaded revolver from his bag when police attempted to arrest him for suspected stealing.

A jury today found him guilty of attempted striking to resist arrest after eight hours of deliberation.

The female officer gave evidence during the trial that she thought she was going to die during the ordeal.

“I saw him unzip the bag, pull out the gun and he was facing me directly,” she told the court.

“He was very close — less than half a metre (away).”

“That was when, in shock, I stepped back and drew my firearm.

“I was trying to fire a string of shots and my gun jammed.”

The constable said after her gun jammed, she saw White-Mayne still holding his gun and facing her.

“(I ran) not very far before I heard a shot and felt pain,” she said.

“I kept going but I believed that I had been shot in the leg.

“After I screamed I heard the male person say something — words to the effect of you’re going to cop this, you dog c***, you’re going to die. It was a death threat.”

“I thought I was going to die.”

White-Mayne will be sentenced at a later date.
