Dylan William Doelz pleads guilty in Chinchilla Magistrates Court to common assault, wilful damage

A 20-year-old Western Downs man who urinated in a McDonald’s drive thru before assaulting the driver of a car waiting in line has landed in court.

A drunk sawmill worker who urinated in a McDonald’s drive-thru before assaulting a driver in queue and damaging his car has fronted a magistrate.

Dylan William Doelz, 20, pleaded guilty in Chinchilla Magistrates Court to common assault and wilful damage.

Police prosecutor Chris Hutchins said on May 21 police received reports of a scuffle between two men at a Western Downs McDonald’s.

When police officers arrived they spotted the Doelz standing with friends next to a vehicle and he appeared to be “intoxicated, argumentative and slurring his words”.

Police approached the victim to obtain his version of events.

“The defendant has urinated in the bushes, approached the victim who was sitting in his vehicle and began bothering him,” Mr Hutchins said.

“The victim exited his car and told him to back off, as the victim was walking back to his vehicle the defendant has approached from behind and punched him in back of the head with a closed fist.

“The victim has reacted in self defence and a fight occurred.

“Police obtained CCTV footage from the McDonald’s. Staff were able to confirm the assault.

“At one point during the scuffle, the victim fell to the ground and the defendant was sighted punching and kicking the victim.

“The defendant entered the vehicle he was travelling in, which was still in queue in the McDonald’s drive-thru.

“The defendant exited the vehicle again, a friend has attempted to stop him however the defendant has approached the victim’s vehicle and kicked the car, its caused damage to the rear of the vehicle and he’s walked away to his group of friends.

“The victim waited for police in his vehicle. Police arrived shortly later.

“The defendant told police ‘obviously there’s no reason for me to hit him’, they were unable to properly interview him due to the level of intoxication.

“He certainly has some issues, but I don’t think it goes far enough to supervision yet.”

Defence lawyer Brad Skuse said Doelz was intoxicated and he accepts the restitution amount sought for damages to the victim’s car.

“Whilst he was intoxicated, your honour, his recollection was a little different,” Mr Skuse said.

“Rather than go into McDonald’s, your honour, and perhaps interfering with other people, he decided to use the bushes as a toilet.

“The other person, the victim, complained and observed that and made some comment and calling him some names.

“It’s his recollection that it was at that point when he kicked the car and the other person came out and they had an argument and he engaged in an altercation.”

Magistrate Gary Finger said he must “pay the penalty” for his behaviour.

“You wouldn’t want someone to kick your car? Then don’t kick someone else’s,” Mr Finger said.

Doelz was fined a combined $800 and ordered to pay $1108.47 in restitution to the victim.

No conviction was recorded.
