John Charles Warner and Johnathan James Warner face Emerald Court for drugs found at The Willows

A Central Queensland father and son faced court together after a police raid uncovered a stash of drugs on their property. Read what happened in court here.

A Central Queensland father and son faced court together after a police raid uncovered a stash of drugs on their property.

John Charles Warner pleaded guilty in Emerald Magistrates Court in July to one count of possessing dangerous drugs before his son, Johnathan James Warner,32, pleaded guilty to the same offence immediately afterwards.

Police prosecutor Tasman Murphy, submitted John Charles Warner’s criminal record to the court, which included a charge from 2019 for a like offence, for which he served a 12 month probation period.

Johnathan James Warner’s had a four page criminal history and his last offence was dated to 2019.

In his case it was for producing dangerous drugs among others, for which he completed a suspended sentence.

Mr Murphy told the court Anakie police conducted a search of the Warner’s property at The Willows on May 14, 2022 about 12pm.

"While no one was home at the time of the search, police noted two stationary caravans on the land, one on the north and the other on the south side," he said. 

"The southern caravan’s door was closed and locked and police forced entry to conduct a search."

The court heard police found a clip seal bag filled with cannabis seeds in a kitchen counter drawer.

Jonathan James Warner’s charges related to a large, dried cannabis plant found in the northern caravan and branch from the plant found in an abandoned car a short distance away.

Both men attended the police station nine days later, on May 23 in relation to the search.

The court heard that at the time of the search, neither men lived at the address any longer.

John Charles Warner told police he used to live in the southern caravan and forgot about the cannabis seeds in the drawer.

Johnathan James Warner lived in the northern caravan and told police the plant was his, and that he should have told the police about it sooner.

Defence lawyer Lauren Townsend represented both men and told the court John Warner was a pensioner who received a $934 fortnightly pension, while Johnathon Warner cared for his father and received a $580 fortnightly carer’s benefit.

She told the court the elder Warner had several health problems, including emphysema, while Johnathon Warner suffered from anxiety and depression.

She said both men had left the address about six months before police searched it.

James Charles Warner was convicted and fined $200 while Johnathan James Warner was convicted and fined $300.
