Clermont man banned from local venues after tipping a drink at the bar tender

The incident arose after another person “stole” his seat on previous occasion.

A Clermont man tipped two beers at a local bar tender before calling police officers “c--- suckers” and “c----” for trying to move him along.

Kyron Marcus Shanks, 26, pleaded guilty in Clermont Magistrates Court on Wednesday, August 11, to committing public nuisance in the vicinity of a licensed premises and breach of bail conditions.

Police prosecutor Sergeant Paul Cramp said police located Shanks outside the Commercial Hotel about 10.45pm on July 16, while attending the venue for a routine inspection.

Sergeant Cramp said Shank tipped two glasses of beer at the bar tender and referring to him as a “f--- wit” before he was told to leave.

Shanks, who had slurred words and glassy eyes at the time, told police the bar tender stole his seat at another venue on a previous occasion, which was why he tipped his beer at him.

He became argumentative towards police and called them “c--- suckers” and “c----” when they tried to move him on.

Shanks told police he was going to head towards the Grand Hotel to drink more alcohol, which was when he was taken into custody.

Sergeant Cramp said Shanks was issued a banning notice, preventing him from entering any licensed premises in Clermont.

On July 25, police were notified that Shanks had been at the Grand Hotel the day before, about 10.30pm.

He later told police he had been at a footy game, and stopped at the venue to use the toilet before leaving, despite understanding he wasn’t meant to be there.

Duty lawyer Sam Foster said his client was a refrigeration mechanic at Clermont, and was extremely embarrassed by his actions.

“He drank too much and it got the best of him,” Mr Foster said.

Magistrate Robert Walker said the facts surrounding the two offences suggested to him that Shanks had an ongoing issue with alcohol.

Mr Walker labelled the behaviour as “abusive” and “completely unacceptable”.

Shanks was fined a total of $600. Due to his lack of history, convictions were not recorded.

He was issued a banning order for all licensed premises in Clermont until November 11.
