Young dad seen drag racing in coastal town before being found over the limit

Dobbed in to police by a resident for hooning, he told police he’d had an argument with his wife and knew he shouldn’t have been driving after having a dozen beers.

A young dad will be without his licence for a lengthy period of time after he was reported drag racing his car at Burnett Heads earlier this month.

Herbert Noel Fischer, 22, pleaded guilty in Bundaberg Magistrates Court on Tuesday to driving under the influence of liquor and driving while disqualified by court.

The court heard police were notified by a resident in Burnett Heads that a man was hooning and driving his car inappropriately.

Officers conducted patrols and found the car that was described to them in the driveway of a Burnett Heads property where they then spoke to Fischer.

During an interview Fischer told police he had consumed about 12 beers before driving.

He participated in a breath test which returned a reading of 0.153.

Checks also revealed Fischer was disqualified from driving by a court order.

The court heard Fischer had drink driving offences in his history.

Fischer, who was self represented, told the court on the day he’d had an argument with his wife and knew he shouldn’t have been driving.

He said he was also going to Alcoholics Anonymous meetings to get help with his drinking issues.

Magistrate Andrew Moloney took into account that Fischer’s plea of guilty came at an early opportunity at that it was Fischer’s manner of driving that brought him to police attention.

He said fines were “still just appropriate”.

Fischer received a total of $2000 in fines and two licence disqualifications, one for 12 months and another for two years.

Convictions were recorded.
