Upon finding out his partner had started a new relationship, a young Bundaberg dad took it upon himself to send her new beau four sexually explicit images of the woman - the mother of his children.

One of the photos featured his ex-partner performing a sex act on him, while the other three images depicted her in underwear.

Magistrate Andrew Moloney told the accused, who cannot be named for legal reasons, that his actions were humiliating to the mother of his two young children.

“They were taken with her trust and you’ve breached that trust in a degrading way and to try and hurt her and to try and humiliate her new partner you’ve sent that image of her performing a sexual act on you,” he said.

“It’s appalling behaviour...”

“Whatever you might have felt about a perceived breach of trust you had for what she did, nothing excuses this, ever.”

Magistrate Moloney told the 21-year-old, who wore a neat black suit and red dress shirt, that “the most important persons in all of their are your children”.

The accused’s lawyer, Craig Ryan, told the court that his client had been blindsided by his partner’s new relationship.

“He had a relationship for a number of years and has two children to the aggrieved, the youngest child... had only just been born when he became aware that his partner had started a relationship, without his knowledge, with someone else. There were other issues surrounding the relationship at that time,” he said.

Mr Maloy said his client had been working odd hours, which caused friction in the relationship.

Feeling blindsided, the accused bombarded his ex’s new partner with threats of harm and sent the explicit images.

Magistrate Moloney told the man that no matter how upset he was over his partner’s new romance, it was totally unacceptable to breach her trust in such a way.

The man pleaded guilty to the offence of distributing intimate images and to also contravening a domestic violence order twice, for which he was sentenced to 12 months’ probation and must complete a men’s behavioural program.

But they weren’t the only offences that brought the accused to Bundaberg Magistrates Court on Monday.

The accused and a friend had been drinking together in the early hours of the morning last year when a man emerged from a creek bed without pants.

The court heard the victim had been washing his pants in the creek, when the accused and his co-accused friend noticed him emerge from the Bundaberg waterway.

The pair questioned the victim about what he was doing without pants, then the accused punched the victim in the mouth.

The victim pushed his attacker, which saw him fall backwards into the creek where he found a 60-80cm pole about the thickness of a street sign pole.

“You approached the victim and challenged him to a fight,” Magistrate Moloney said.

“During that fight the victim received injuries to his ribs and he received a broken hand when being hit by the pole.”

The accused’s co-accused friend, who was sentenced to 60 hours’ community service in a separate sitting, also attacked the victim once the initial fight was over.

The accused admitted starting the fight and using the steel pole, saying it wasn’t right the victim wasn’t wearing pants.

The magistrate labelled the attack as drunken and gratuitous violence in sentencing the accused to 60 hours’ community service for the charge of assault occasioning bodily harm whilst armed in company.

He must also pay $500 compensation to his victim.

Magistrate Moloney said the only thing saving the accused from jail time was the random nature of finding the pole in the creek, rather than being armed with it from the start.

The court heard the accused had battled issues with alcohol and depression and had taken steps to address his behaviour and was on speaking terms with the mother of his children.

He is also working in retail with “an excellent work history” and a goal of working his way up to management.

No convictions were recorded for any offence.
