Police prosecutor Leon Casey told the court Wiggins told officers he had consumed alcohol earlier that day.

“The defendant was unsteady on his feet, speech and movements were very slow and deliberate and when asked, the defendant stated he’d been drinking earlier that morning,” he said.

Police alleged the possibility that Wiggins could have been working at the time, however, Magistrate John McInnes told the court it was not fair to take it as an aggravating circumstance in the absence of evidence.

Mr Casey said Wiggins had initially refused to give a specimen, but when he did two hours later, it read 0.224 per cent.

Wiggins, who self-represented, told the court he was “really surprised at the reading” as he felt normal apart from being tired.

The defendant told the court he was now unemployed and had sought support from Bridges Drug and Alcohol Service.

It was heard he had pleaded guilty at the earliest possible time and while he’d had a dated history of drink driving, had no criminal history or recent offences.

Mr McInnes sentenced Wiggins to a 13-month licence disqualification and a $1300 fine which he referred to SPER.

A conviction was recorded.
