Dylan Andrew James Martin charged with unlawful wounding

An unruly house guest with a history of violence was so upset about being asked to leave a gathering he returned ready to unleash gruesome revenge.

A man who was asked to leave a social gathering after becoming agitated returned a short time later, brandishing multiple knives and threatening to kill everyone.

Appearing in the District Court in Bundaberg, Dylan Andrew James Martin, 27, sat in the dock as the details of his offending were read out.

The court heard that on March 14, 2021, Martin had been drinking with his girlfriend, her housemate and the housemate’s partner at a Bundaberg home when the defendant started to become agitated and speak inappropriately.

He was asked to leave, but returned a while later.

“The defendant returned to the house sometime later and he was holding multiple knives saying ‘I'm going to kill you all’,” Crown Prosecutor Erin Kelly told the court.

When the defendant’s friend went to tell him to leave, he walked towards her, swinging the knives.

The court heard that the victim attempted to push him away and in the process he wounded her arm with one of the blades, leaving a 2cm wound deep enough to reveal fatty tissue.

A photo of the injury and a victim impact statement were handed to the court and it was heard the wound took a month to heal and left the victim with scarring.

Martin was taken into custody that day.

Barrister Nick Larter discussed various hardships throughout Martin’s life and noted he’d worked for some time on fishing trawlers.

Mr Larter said Martin had been receiving treatment to help control ADHD and bipolar disorder.

In sentencing, Judge Katherine McGinness noted Martin’s “serious and relevant” criminal history including numerous violent offences and warned him that if he did not address his anger and drug issues he was at risk of being declared a serious violent offender.

“You yelled out threats to kill them all,” she said.

“Wounding is a serious offence, particularly where a knife is used, it increases the risk of significant injury, if not death.”

Martin pleaded guilty to one count of unlawful wounding.

Taking into account the time he served from March 14, Martin was sentenced to two years’ imprisonment with immediate parole.
