A New Zealander given a suspended jail term for his role in the one-punch killing of Cole Miller has been deported

A NEW Zealander involved in the one-punch killing of Cole Miller has been deported under tough immigration laws.

A NEW Zealander involved in the one-punch killing of Cole Miller has been deported.

Daniel Maxwell, 22, briefly walked free after receiving an 18-month suspended jail sentence last week for his involvement in Mr Miller’s death.

A brief bureaucratic bungle allowed him to walk out of the court on August 17, instead of being sent to a detention centre to be processed for deportation – but he was rearrested the same night.

Maxwell, who walked away laughing from the assault on the 18-year-old Miller, had been in Brisbane Immigration Transit Accommodation Centre since his rearrest.

His visa was cancelled under tough immigration laws introduced by the Coalition Government, which demand foreign-born criminals are deported if they are sentenced to 12 months’ jail or more.

Detainees can remain in detention for months, even years, if they choose to fight the visa cancellation or appeal their sentence.

It is understood Maxwell voluntarily agreed to leave Australia and flew back to New Zealand on Friday morning.

It is still possible for him to appeal the visa cancellation from New Zealand.

While originally charged with unlawful striking causing death, he pleaded guilty to affray and common assault.

The court heard a “drunk” Maxwell tried to start three fights before he and co-accused Armstrong Renata crossed paths with Mr Miller and his friend in Fortitude Valley in January last year.

Maxwell had said, “Do you want to see something funny?” before approaching the duo, challenging them to a fight and punching Mr Miller in the chest.

The court was told Renata delivered a fatal blow to Mr Miller, causing him to fall to the ground.

The 18-year-old died in hospital the following day after his life support was switched off.

Renata, 22, has pleaded guilty to one count of unlawful striking causing death. His case will be mentioned on September 25.

Department of Immigration figures show 983 criminals, including 299 that were living in Queensland, had their visas cancelled and were deported in 2015-16.
