Amy Maree Lindsay from Taree has been denied bail and remanded in custody since September 1.
When she appeared in the online bail court it was heard that she was already on bail for allegedly breaching an apprehended violence order designed to protect the boy.
At the time, acting magistrate Amanda Coultas-Roberts said Lindsay had faced Taree Local Court on July 30 this year charged with contravening the order and was granted bail but directed not to have a relationship with the boy.
She has been charged with grooming the child for unlawful sexual activity and having sexual intercourse with the same 15-year-old.
It is alleged the offences took place this year.
Lindsay has pleaded not guilty to all three charges: contravening a prohibition or restriction in an apprehended violence order; grooming a child for unlawful sexual activity and having sexual intercourse with a child between 14 and 16 years.
During her unsuccessful bail application on September 1 her lawyer told the court that the mother of three is an Indigenous woman who has never been in custody before and urged the magistrate to grant her bail so she could attend her nephew’s funeral later that week.
Lindsay, who appeared by video link from the police cells, cried and held her head in her hands as her lawyer told the court she would play a significant role in “dressing” his body for the funeral.
But the magistrate said the charges were “very serious” and that it was “of concern that she was already on an AVO to prohibit her from having contact with the (alleged) victim”.
Ms Coultas-Roberts also said Lindsay had contacted the mother of the alleged victim urging her to allow the child to access a phone so that she could contact him.
“It seems to me a strong prosecution case and if convicted would very likely get full-time imprisonment,” Ms Coultas-Roberts said.
She said that given Lindsay’s “willingness to breach bail and an AVO” there were no further bail conditions that her lawyer could offer to ensure the safety of the alleged victim.
Lindsay’s case has been listed for a two-day hearing at Taree Local Court beginning on April 23 next year.
