A former Sydney cop shot in the face in Melbourne is on life support, prosecutors have told a court where two Irishmen appeared charged with his attempted murder.

Prosecutors in Melbourne Magistrates Court on Monday said the prognosis of Sid Morgan, who remains in an induced coma, is unclear and the outcome could mean different charges for Irishmen Mark Dixon, 30, and Jack Harvey, 26, who were dramatically arrested in NSW last Wednesday over the shooting on February 21.

Dixon and Harvey were extradited to Victoria after a two-day manhunt which involved heavily armed police raiding a motel in Byron Bay before they were tracked down in Broken Head.

Both have been charged by Victorian police with attempting to murder Mr Morgan, 53, in the middle of a street after an argument in the western Melbourne suburb of Point Cook.

Prosecutors told the court police wanted 10 weeks to put together their brief of evidence against the men, rather than the usual six weeks.

Mr Morgan remained in an induced coma and on life support, she said.

But a lawyer representing Dixon and Harvey disputed the claims about Mr Morgan’s condition.

She said she understood he was in a medically induced coma, as was common in matters involving a person who has suffered head trauma.

“Saying he is on life support, with all due respect, may be an exaggeration,” she said.

The lawyer also disputed prosecution claims more time was needed to seek warrants in relation to evidence out of state, arguing a car in NSW had already been forensically searched.

It’s alleged the two men fled Victoria and went to NSW after the shooting. But the prosecutor said the car was not the only evidence interstate.

Magistrate Duncan Reynolds granted the usual six weeks to compile a brief and said police could come back to court for an extension if more time was needed beyond April 15.

Mr Morgan was acquitted of murder after he fatally shot a family member who had allegedly molested three girls in 1995.

The murder trial was told Mr Morgan used his police badge to get inside his brother-in-law’s Oakhurst home before shooting him six times with his service revolver.

The case attracted widespread publicity at the time and supporters strung up placards outside the courthouse in support of him killing the alleged child molester.

But Mr Morgan was knocked back from rejoining NSW Police and instead made a name for himself in real estate in Sydney’s Hills district.
Dixon and Harvey, who did not apply for bail, are expected to return to court for a committal case conference on May 27.
