A Toowoomba Magistrate has told a recidivist domestic violence offender a jail term was the only appropriate sentence for his disrespectful and abusive behaviour towards a former partner.
On Tuesday, December 3, before the Toowoomba Magistrates Court Kingsley William Thomas Errington pleaded guilty to stealing from a former partner, three aggravated breaches of the DVO, and breaching his bail conditions.
The court heard at 8am on September 7, the 37-year-old entered an ex-partner’s home and found her sleeping in bed.
Errington then sat on the side of the bed and kissed the woman on the mouth, waking her.
The court heard he did not have permission to be at the residence and when the woman woke she asked him to leave and asked him what he was doing in the home.
Before leaving the home, he stole a small amount of cash from the woman’s purse and cigarettes.
He then sent a number of abusive messages to the woman.
Magistrate Mark Howden said the abusive behaviour continued three days later after the man again entered the woman’s home unannounced and silently watched her complete household chores
“It seems to me Mr Errington that you have no regard whatsoever for the privacy or rights of the aggrieved,” he said.
“You have continued to breach the order and without any regard for her feelings whatsoever, entered her residence on a number of occasions and (verbally) abused her on a number of occasions, and invaded her privacy.
“Your behaviour is… menacing and it cannot be tolerated by the courts.”
Mr Howden sentenced Errington to a 9 month jail term and said his release was up to the parole board.
Errington has more than 40 charges remaining before the courts, including drug and fraud charges, which were adjured to be mentioned before the court on January 17, 2025.
He is eligible to apply for parole.
