James Harold Davey faces Toowoomba Magistrates Court for attacking NDIS support workers

A court has been told a number of NDIS support workers were assaulted by a Toowoomba client who struggled with explosive outbursts of anger.

A Toowoomba man who continues to commit acts of violence against his NDIS support workers has been given one last chance in court and the benefit of not having a conviction recorded.

James Harold Davey, 21, pleaded guilty to committing common assault, while on a recognisance order for assaulting his roommate.

Police prosecutor Anita Paige said Davey assaulted his support worker during a cooking program when he became frustrated cutting onions, on February 21.

Ms Paige said before the physical altercation Davey told the worker: “if you touch that cutting board I’ll cut your f--king face off”.

After the man moved the knife away from Davey, he punched the worker in the face.

The court was told Davey fronted court in 2022 for assaulting a different NDIS support worker after he thought the woman was speaking to police about his actions.

A month later Davey assaulted his roommate.

Duty lawyer Alysha Jacobsen said Davey had an issue with anger and was working through a number of avenues to get it under control.

Ms Jacobsen said Davey was an NDIS participant due to having high-end autism which was high functioning, mild intellectual impairment, and anxiety.

Ms Jacobsen said after his outbursts, Davey was very remorseful and never wanted to hurt anyone.

Davey told the court that he made a promise to the police that he would not assault anyone else.

Magistrate Louise Shephard said she would give Davey one more chance by not recording a conviction, and fined him $600.

Ms Shephard also ordered Davey to pay $500 for breaking his recognisance order.
