Brent Franklin Davis: Man possessing 255 child abuse videos says it’s ‘not who I am’; sentencing delayed

A man who possessed more than 250 videos of child abuse material and discussed having sex with Gold Coast teenagers has told a court he was extremely remorseful for his actions. Read why he’s still out on bail.

A man who was found with more than 250 files of child abuse material including children as young as two years old will not be back in court for more than two months.

Brent Franklin Davis, 41, pleaded guilty to one count of using a carriage service to access child abuse material, one count of using a carriage service to transmit child abuse material and one count of using a carriage service for child abuse material when he appeared in the Southport District Court on Wednesday, April 30.

He was due to be sentenced that day, however, a problem with a psychologist report has meant Davis will be out on bail for a few more months.

The court heard a police search executed at Davis’s address led police to detect the offending in January 2024.

Police conducted an examination of Davis’s iPhone and found a video of teenage boys captioned ‘Twincest’.

A search of the phone also found a WhatsApp conversation starting in January 2023 between Davis and another man talking about sex with teenage boys and meeting teenage boys on the Gold Coast.

In the conversation Davis talked about trying to meet with a 15-year-old boy visiting at an Ashmore resort and sent sexual photos of a 16-year-old boy he claimed he had sex with.

“I actually know a couple of guys that are pervs and are into what we’re into,” Davis said in the conversation.

“Met this guy ... He ended up telling me he has ... sons and he says he plays with them … how hot is that whether or not it is true.”

The police also found 255 videos of child abuse material on Davis’s laptop depicting children as young as two years old.

In an interview with police, Davis made admissions to the ‘Twincest’ video but said he didn’t know they were underage.

He initially denied having access to any child abuse material.

In court, Davis said he was extremely remorseful.

“That’s just not who I am as a person,” he said.

The Crown prosecution said the material submitted by defence, including a psychologist report, did not change the view that this was not an exceptional case and Davis should serve time in custody.

The court heard the psychologist report omitted information relevant to the offending, including whether Davis had an attraction to or interest in children, or why his risk of reoffending was considered low.

Davis’s defence barrister Nicholas McGhee, instructed by Gatenby Criminal Law, said the report showed the treatment Davis had received and other indicators of his remorse.

The court heard the defence had had the report since January 4, 2025 and had only provided it to the prosecution the day before.

Judge Rowan Jackson KC said the defence had been shockingly late providing the report and questioned if it was even admissible, noting the information missing.

“You’ve come along here to say this man is very significantly rehabilitated and he should not be sent to jail, and I’m telling you I am by no means at all persuaded,” he said.

After a short moment with his client, Mr McGhee asked that the matter be adjourned and Davis would need some time to fund a forensic psychologist report.

His bail was enlarged and he will appear in court again on August 22.
