Ocean Grove doctor Shafiul Milky found guilty of rape and sexual assault of six patients

A jury has handed down a verdict in the trial of an Ocean Grove doctor accused of the rape and sexual assault of six of his patients.

An Ocean Grove doctor has been found guilty of the rape and sexual assault of six of his female patients.

A jury found Shafiul Milky, 59, guilty of all 15 charges of indecent assault, sexual assault and rape of his patients while he worked at the Ocean Grove Peninsula Family Medical Practice and with the Home Doctor Service between September 2012 and February 2019.

The jury handed down the verdict in the County Court of Victoria on Monday afternoon after eight days of deliberation.

During the trial, the court was told Milky touched the breasts of three of his patients after telling them they needed an examination, including a 19-year-old woman who had complained of back pain.

One of the women said Milky told her to pull her pants and underwear down so he could “feel her pulse” on her inner thigh.

Another patient was told she needed an “urgent” pap smear and Milky inserted two of his fingers while he “made noises” like a “groan …(or a) moan” and said something like “very nice”.

In many of the incidents at the clinic, the court was told a nurse was present in the room and alleged nothing was inappropriate.

During the last incident, Milky was working with the National Home Doctor Service and visited the patient at her home after she had complained of a headache for several days.

In the course of the visit, Milky touched her breasts, pulled her top up, told her to “hold me tight” and placed his hands near her crotch.

The woman said Milky attempted to kiss her six or seven times and had tried to move her hand towards his crotch.

A forensic physician reviewed the women’s statements and found Milky’s examinations were “inappropriate”.

Prosecutor Richard Pirrie said the physician found Milky “used his position as a general practitioner to engage in touching or penetration that was sexualised and not warranted”.

At least three of the women came forward in June 2019.

One woman said she did so after reading an article about Milky’s APHRA suspension in the Geelong Advertiser.

Milky will return to the County Court at a later date for sentencing.
