‘Misread the signals’: BMW driver apologises in court to stranger he kissed nonconsensually

Tayfun Mulayim asked a stranger to help him put on a gold bracelet before nonconsensually kissing her, only leaving when she said she had a boyfriend, a court has heard.

A BMW driver claims he had “respect to stop” after the stranger he non consensually kissed in a Geelong car park told him she had a boyfriend.

Tayfun Mulayim fronted Geelong Magistrates Court on Wednesday and pleaded guilty to kissing the woman without her consent.

The court heard the victim parked her car in a Geelong car park while she waited for a friend at 9.24am on October 19 last year.

Mulayim was parked two car spaces away in his white BMW playing loud music from his car.

He was standing behind his car looking into the boot when he asked the victim for help putting on a gold bracelet.

The victim exited her car, and helped him clasp the bracelet.

As she was helping, Mulayim told her “you’re so gorgeous”.

The victim felt extremely uncomfortable so she thanked him quickly and returned to her own vehicle, but left her windows down while she was still waiting for her friend.

Shortly after, Mulayim approached her driver’s side window.

“Excuse me, I’m going to have to do this,” Mulayim said before he proceeded to kiss the woman through the car window.

The victim refused Mulayim by pulling her head back and saying “stop”.

Mulayim needed a reason on why he was rejected, and asked her “why not?”.

The victim stated she had a boyfriend before putting up her window and locking her car doors.

Mulayim got back into his BMW and drove away.

The victim was left crying and shaken after the incident, which she reported to police shortly after.

Police obtained CCTV footage of the car park which displayed the non consensual kiss.

Mulayim was located by police sleeping in his car, which he was living in at the time and he refused to say anything during an interview about the incident.

The court heard the kiss was an “impulsive sort of situation” for Mulayim.

“I apologise if I misread the signals and caused her any stress,” Mulayim said in court.

“I had that respect to stop after she said she had a boyfriend.”

Mulayim was fined $300 and sentenced to a six month good behaviour bond without conviction for this incident.
