Darren Kirwood, 31, granted bail after Winchelsea fatal

The alleged driver in a fatal crash in Winchelsea that killed mother of three Kylie Doak has been granted bail.

Darren Kirwood limped into the dock in a white T-shirt for the third appearance of his bail application in Geelong Magistrates’ Court on Wednesday.

He was supported by more than a dozen friends and family seated in court.

Kylie Doak’s brother and two other family members were also seated in court.

The court previously heard Mr Kirwood, a senior Barwon Prison guard, was not likely to replicate his alleged offending.

Prosecution will allege Mr Kirwood was driving home from his best mate’s wedding with a BAC of 0.116 on the night of the crash, which killed Kylie Doak and left her daughter in hospital.

Mr Kirwood’s lawyer Alex Good tendered a report from the Bail Safe program to the court in a bid to get his client out of custody.

He also presented a roster of supervision created by Mr Kirwood’s family and friends to ensure he has around the clock support.

The prosecution told the court Mr Kirwood was an unacceptable risk to society and that the victim’s family opposed bail.

Magistrate Urfa Masood said the unacceptable risk posed the community by Mr Kirwood could be mitigated by bail conditions.

“It is not for me to sentence Mr Kirwood, just to determine bail,” she said.

Mr Kirwood and his family broke into tears when Ms Masood granted him bail with strict conditions.

He will have a curfew from 8pm to 6am, is banned from driving and drinking alcohol, have twice weekly drug and alcohol screening and will have to comply with the Bail Safe program as well as his mental health treatment plans.

Mr Kirwood only spoke briefly during the hearing to accept his bail conditions.

He will next appear before Geelong Magistrates Court on August 13 for a committal hearing.
