Deans Marsh man Noah Fagan guilty of speeding, drug possession

A local musician and landscaper has left his dog to die in his car alongside his smashed bong after he crashed into a tree while speeding at 155km/h.

A Deans Marsh musician and landscaper was driving at 155km/h when he slammed into a tree, tore his car in half, and then fled the scene, leaving his dead dog in the wreckage.

Fagan was driving along Drayton Rd, Waurn Ponds at 2.30am on October 16, 2022, when he lost control of his Holden Commodore and ploughed into a tree.

The musician was lucky to walk away from the smash, which tore his car in two and left every seat in the vehicle destroyed, aside from the driver’s seat.

Fagan fled the scene on foot.

Another driver reported the accident to emergency services.

Paramedics located Fagan 2km from his car and he was taken to hospital to treat his injuries.

He was not breath tested.

Police searched the wreckage of his car and located Fagan’s dog, which had died during the accident.

A smashed glass bong, cannabis, magic mushrooms, MDMA and cannabis seeds were also found by investigators.

Magistrate Ann McGarvie described Fagan’s driving as “incredibly dangerous”.

“It is your fault your dog is dead,” she said.

“I am astounded you even walked away from the accident.

“It is pure luck no one else happened to be around.”

Fagan was fined $500 and his licence was suspended for 18 months.
