Jason Ross Allan Fourmile alleged to have murdered five-year-old son

A Yarrabah man who police alleged tortured and murdered his five-year-old son had his matter heard in a Cairns court on Friday. Full report on the brief hearing.

A Yarrabah man accused of the brutal torture and murder of his five-year-old son had his matter mentioned in the Cairns Magistrates Court on Friday.

Jason Ross Allan Fourmile, 24, did not appear but was represented by Sharon Giardina before Magistrate Sandra Pearson.

The charges Mr Fourmile faces include one count of grievous bodily harm, one count of murder, one of torture and four of assault occasioning bodily harm against his five-year-old son Caiden.

Mr Fourmile’s appearance before the court was excused.

Ms Giardina said Mr Fourmile was expected to apply for legal aid.

“The pathology report was still outstanding on the brief,” she said.

Ms Giardina said she wished to place on the record that up until now Osborne Butler had been privately retained by Mr Fourmile.

“But he will be applying for legal aid and given the nature of the charges the likelihood is it will be kept in-house,” she said.

Magistrate Pearson set down Mr Fourmile’s next appearance for April 21.

“You still wont have the pathology report by then,” Magistrate Pearson said.

Police prosecutor Sergeant Jon Hanley then read to the court a letter which confirmed there were some tests still be undertaken.

“The letter details to the Detective involved there’s a number out outstanding tests,” he said.

“Long story short, the autopsy report is due June or July 2023.”

“We have been advised,” Magistrate Pearson said.

“ (Mr Fourmile) will remain on remand.”
