Lina Marie Daley convicted for manslaughter matter appeared in Cairns Magistrates Court

A Cairns mum previously convicted over the manslaughter of her infant son after he overdosed on methylamphetamine has had another matter heard in court.

A Cairns mum previously convicted over the manslaughter of her infant son after he overdosed on methylamphetamine has had another matter heard in court.

Solicitor Christjan Corias appeared on behalf of Lina Marie Daley in Cairns Magistrates Court on Friday.

Ms Daley was eligible for parole in March 2022 following an eight-and-a-half year jail term being imposed after pleading guilty to manslaughter over the overdose of her 13-month-old son Makavelli Leoni in 2018.

On this occasion Ms Daley was initially charged with one count driving without a licence disqualified by a court order, one count obstruct police, two counts possession of drug utensils or pipes etc for use, and one count unlawful use of motor vehicles aircraft or vessels use.

Senior Constable James Chapman requested to drop the two counts possession of drug utensils or pipes charges.

“In regards to Ms Daley there are two possess utensil charges, prosecution will be offering no evidence,” he said.

Mr Corias requested a long plea of December 19 and the date was set. She was remanded in custody with notice to appear next time by video.

Ms Daley applied for bail back in October but it was denied after Magistrate Terrence Brown had real concerns because she had only just been released on parole for very serious charges so the case was relisted.

Police allege in October a tyre deflation device on Yorkeys Knob Road was used to successfully stop an allegedly stolen Alfa Romeo hatchback.

Ms Daley and 36-year-old Manunda man Alfred Maynard William Kyle allegedly fled the car on foot and were located a short time later hiding in a nearby cane field.

Police found a meth pipe, clip-seal bags, scales and a shotgun shell in the car.

At the 2021 sentencing in the Cairns Supreme Court Justice Jim Henry described the manslaughter as a failure to meet a duty of care “because of your drug addled criminal negligence”.
