A CAIRNS mum convicted of the manslaughter of her infant son has been taken down by the dog squad in a Yorkeys Knob cane field after running from an allegedly stolen car.

Lina Marie Daley was eligible for parole in March 2022 after pleading guilty to manslaughter over the fatal methylamphetamine overdose of her 13-month-old son Makavelii Leoni in 2018.

Police allege on Tuesday tactical crime officers deployed a tyre deflation device on Yorkeys Knob Road to successfully stop an allegedly stolen Alfa Romeo hatchback.

Manoora woman Ms Daley, 24, and 36-year-old Manunda man Alfred Maynard William Kyle fled the stolen car on foot but were located a short time later hiding in nearby cane fields, police allege.

A 15-year-old passenger was also in the alleged stolen vehicle and police found a meth pipe, clip seal bags, scales and a shotgun shell in the car.

Ms Daley was charged with unlawful use of a motor vehicle, unlicensed driving, obstructing police and possession of drug utensils.

Mr Kyle was charged with unlawful use of a motor vehicle, possession of a knife in a public place and failing to dispose of a syringe.

Ms Daley appeared before Cairns Magistrates Court via video link from the Cairns watch house dressed in back with no shoes on Wednesday and applied for bail.

Police prosecutor Ash Gregg opposed bail given her lengthy criminal history after being charged in connection with the death of her baby son.

“She just made some fairly extreme steps to avoid the police,” he said.

“Her drug habit has not abated and her offending has not abated.”

Through her lawyer she told the court she had a place to stay at her grandmother’s Manoora house, she had been attending appointments with ATODS.

Magistrate Terence Brown noted a prosecution concern of serious offending linked to drug abuse.

“The court has real concerns about this notice so soon after being released on parole for very serious charges and now engaging in very serious and dangerous behaviour and still having a lifestyle involved in the drug scene,” he said.

“I’m not satisfied that there are any conditions that I can impose that reduce the risk to an acceptable level.”

Bail was denied and the case relisted for hearing on November 11.

At a 2021 sentencing hearing in the Cairns Supreme Court Justice Jim Henry noted the “voluminous evidence” before him showing Ms Daley’s efforts to address her drug and psychological issues, describing it as “an impressive accumulation of creditworthy rehabilitative progress”.

At the time, in setting a parole eligibility date of March 23, 2022, Justice Henry took into account Daley’s 888 days already served in custody.
