Cairns crime: Duncan John Kingsbury-Anderson on bail after night out turned sour

A Cairns businessman who police allege repeatedly tried to run down a man on foot in his four wheel drive has made a bid for bail, following his arrest on three charges including dangerous operation of a motor vehicle.

Police will allege a man who repeatedly tried to run over an 18-year-old in Cairns City in the early hours of last Sunday morning later told a service station operator “he’ll be very sore” and “don’t f*** with a crab fisherman”, a court has heard.

The Cairns Magistrates Court heard the 18-year-old complainant suffered a brain bleed and grazing to his arm and other parts of his body after allegedly being struck by a four-wheel drive bullbar.

Duncan John Kingsbury-Anderson appeared via video link from Cairns watch house before Magistrate Susan Warrington on Monday.

Mr Kingsbury-Anderson was charged with assault occasioning bodily harm while armed, possession of tainted property and dangerous operation of a motor vehicle.

No plea was entered.

Opposing bail, prosecutor Senior Constable David Coleman said the complainant was intoxicated and his last recollection was being at a nightclub before he woke in daylight in the Reject Shop car park on McLeod St.

The complainant walked to a nearby service station and was subsequently taken by ambulance to Cairns Hospital.

Snr Const Coleman said much of the alleged offending was captured on CCTV.

“Around 2.30am the victim has gone to the service station to purchase food and a Mitsubishi Pajero pulled in and parked beside the victim and the victim remained seated while eating,” Snr Const Coleman said.

“The defendant exits the driver’s seat – a few minutes later the victim appears to stand up, opening the front passenger door of the vehicle before closing it again and walking away,” he said.

Mr Kingsbury-Anderson then allegedly yelled at the victim and attempted to assault him, the court heard.

“The victim in self-defence delivers two punches to the defendant,” Snr Const Coleman said.

Snr Const Coleman said the complainant walked away down McLeod St and the vehicle then allegedly accelerated toward the victim, crossing the centre island, and the complainant jumped out of the way.

Mr Kingsbury-Anderson then allegedly reversed at speed in the wrong direction.

The complainant was allegedly hit by the bull bar.

“It is somewhat concerning such a small incident resulted in a persistent and aggressive attack,” Snr Const Coleman said.

He said a couple of hours later, Mr Kingsbury-Anderson allegedly returned to the service station and told the operator he found the complainant and he would be “very sore” and “don’t f*** with a crab fisherman” and that the complainant had said “oh please don’t hit me, please don’t get me mate, you’re f***cking kidding me”.

Mr Kingsbury-Anderson was arrested around 11am on May 28 on Grafton St.

Defence solicitor Davina Lucas told the court the charges would be “predominantly disputed” and it was difficult to ascertain what police were relying on for the allegations.

She said Mr Kingsbury-Anderson moved from Tasmania to Cairns in May 2021 and worked for Cairns Hardware as a yard boss as well as running a garden maintenance business on weekends.

Ms Lucas said Mr Kingsbury-Anderson had no Queensland criminal history and his Tasmanian record was mostly traffic offences.

Magistrate Susan Warrington released Mr Kingsbury-Duncan on bail on the condition he stay at his place of residence on Grafton St, and report to police twice a week.

The matter was adjourned to June 27.
