Update for alleged street racers after fatal Monterey crash

There has been a development for three people accused of playing a role in a fatal street racing crash that killed two children and injured another.

There have been further legal delays for three people who were allegedly involved in a deadly street racing crash that killed two young brothers and injured another child.

Jimmy Martin Brito, 33, was allegedly driving a blue Subaru WRX at 9.50pm on August 25 last year when it smashed into a tree at a busy intersection in Monterey, in Sydney’s south.

In the moments leading up to the crash, police claim he was drag racing against an Audi driven by Adam Yurun, 24, which also contained passenger Raquel Marie Borg, 24.

The competing cars allegedly reached speeds of more than 136 km/h in a 60 km/h residential zones along The Grand Parade in Monterey before Mr Brito lost control of his car.

Police claim he crossed over two lanes of traffic onto the wrong side of the road before he ploughed into a pole, killing his nephews Peter Abreu, 9, and Xavier Abreu, 10.

A nine-year-old girl was hospitalised after she sustained minor injuries in the horrific collision.

Police allege the children filmed Mr Brito from inside the car as he reached speeds of more than double the signposted limit during the 12km journey from La Perouse.

He is facing 10 charges, including two counts of manslaughter, two counts of dangerous driving occasioning death at a speed more than 45 km/h over the speed limit, and one charge of organising or promoting a race between vehicles.

His alleged drag racing opponent, Mr Yurun, has been charged with eight offences including two counts of aiding and abetting a manslaughter, two counts of aiding and abetting aggravated dangerous driving occasioning death, and one charge of organising or promoting a race between vehicles.

Ms Borg has been charged with two counts of concealing a serious indictable offence after she allegedly witnessed the fatal crash but did not stop to help or call the police.

Lawyers for all three accused appeared in Sydney Downing Centre Local Court on Thursday to ask for an adjournment to allow for further negotiations with the Director of Public Prosecutions.

The court heard a case conference has been held between the parties, but more time was required to come to an agreement.

“Negotiations are on foot,” Mr Yurun’s lawyer Karen Asal told the court.

Magistrate Margaret Quinn agreed to adjourn the matters until July 11, which will mark nearly 11 months since the fatal crash.

The horrifying collision was captured on surveillance footage from nearby houses that reveals the moment the Subaru WRX appears to leave the road and become wrapped around a tree.

The impact was so forceful that the engine of the Subaru flew out of the bonnet and landed several metres away.
