Melbourne man Kristian John Convery has been charged with acting as an auditor for four tax agents and 56 entities despite being permanently disqualified, following an investigation by ASIC.

Mr Convery was first banned in May last year.

The alleged conduct is reported to have occurred between June 2024 and January 2025.

ASIC also alleges that Mr Convery created a series of false documents – a letter and 47 audit reports – intending for them to be accepted as genuine by others or used to obtain a benefit.

The matter, which was before Melbourne Magistrates’ Court on Wednesday and was listed for a further hearing on March 4, is being prosecuted by the Office of the Director of Public Prosecutions following a referral from ASIC.

Making a false document with the intention it be accepted as genuine carries a maximum penalty of 10 years’ jail, while falsifying documents to obtain a gain attracts up to seven years.

Acting as an auditor of a superannuation entity while knowingly being disqualified carries a maximum of two years behind bars.
