The Black Lives Matter protest in Sydney not have been declared legal had a senior police officer not given an organiser the green light only 48 hours before it was due to take place.

The NSW Court of Appeal published its reasons for approving the protest on Tuesday and made it clear that a police application to stop it, lodged at noon on Friday, had a fatal flaw.
