NSW’s top judge takes aim at Victoria on class actions

NSW Chief Justice Andrew Bell says Victoria’s emergence as the preferred forum for class actions is “unfortunate”, and warns that solicitors charging contingency fees are breaking lawyer conduct rules.
In a speech to the Association of Litigation Funders in Sydney on Tuesday, Chief Justice Bell said legislation in Victoria in 2020 that introduced contingency fees had “skewed” the market for class actions.
