ICAC loses High Court appeal against Margaret Cunneen
The Independent Commission Against Corruption has lost a landmark High Court case against Crown prosecutor Margaret Cunneen that it says could narrow the scope of its investigative functions and jeopardise several inquiries.
The High Court ruled the ICAC had no power to conduct an inquiry into allegations Ms Cunneen perverted the course of justice, because the alleged conduct was not "corrupt conduct" as defined under section 8(2) of the ICAC Act.
