Salt Creek kidnapper Roman Heinze is suing SA Police for selling off the 4WD he used to run down and bludgeon a German backpacker — and his son for being “a money-hungry turd”.
In a rambling, handwritten civil claim, Heinze — serving a 22-year prison term — says police had no right to “dispose of or destroy” the vehicle used in the infamous kidnapping.
He accuses them of “deliberately misconstruing” the 4WD as his property, insisting it actually belonged to his now-dead brother — meaning he is owed $12,000.
“I am the only one willing to fight for my dead brother’s rights (against an) injustice done towards him,” Heinze writes.
”How was this possible in this day and age? You just take someone’s property, an innocent person’s property, and destroy it.”
The claim, filed with the Adelaide Magistrates Court, is one of three lawsuits being pursued by Heinze from his Yatala Labour Prison cell.
He is also suing his daughter’s ex-boyfriend, claiming the man has $26,089 worth of his possessions in a WA storage unit and will not reveal its location.
Heinze’s final suit is against his son Jason who, he asserts, “took possession” of his prized fibreglass boat, an air conditioner and other items valued at $15,018.
“It is with mixed feelings and regret that has forced me to make the decision at hand to (sue for) theft and also destruction and damage and misuse of personal property,” he writes.
“It pains me that Jason, of all my kids, has turned out a money-hungry turd.”
At Salt Creek in February 2016, Heinze, 62, he stripped and bound a Brazilian backpacker with the intent to rape her.
He also repeatedly struck a German backpacker with a hammer and his vehicle — she survived but the 4WD was left streaked with her blood.
In his lawsuits, Heinze says that vehicle should not have been confiscated as it “belonged to my brother, 100 per cent”.
“I lent it from him on a few occasions (and) noticed faults which I offered to fix for him as a brother would for his sick and dying brother,” he writes.
“It was and has been deliberately misconstrued and thought of as my property … this was deliberately done by SAPOL.”
He also claims his own lawyer “did nothing” to prevent to prevent the seizure.
“If (a car) was stolen, it would have to be returned to rightful owner … is this not so and the case?” he writes.
“So why is it in this case wasn’t my brother’s car returned to him or after he died made available for his family and next of kin?”
Heinze accuses his daughter’s ex-boyfriend of “deliberately ignoring” him and “avoiding contact” about his belongings.
He wants items ranging from “an imported German cupboard” to “high-end goose down quilts” and a “West End custom frame mirror” returned, or paid for in full.
Heinze also asks his son be ordered to immediately return his boat, motor, trailer and all fishing gear, regardless of his imprisonment.
“I have been trying to get all these items and my belongings returned for three years now … sadly, this is the only way left to me,” he writes.
Police, the ex-boyfriend and Jason Heinze have yet to file defence papers with the court.
