Three men with ties to outlaw bikie gangs sold hundreds of unclassified – and therefore illegal – pornographic films and magazines through adult stores, a court has heard.
Michael John Bennett, Nathan David Hurcombe and Dryden Stewart McDonald faced the Adelaide Magistrates Court on Tuesday.
They are jointly charged with selling prohibited items, namely unclassified adult products that “would be classified as R or X” had they been submitted to censors for approval.
Bennett, 37, of Dublin, is separately charged with one count of possessing a prescription drug.
Together with Hurcombe, 38, of Salisbury East, and MacDonald, 41 of Blair Athol, Bennett is jointly charged with DNM Entertainment Pty Ltd.
The joint charge relates to alleged offending at three locations – Adults R Us at Blair Athol, DNM Adult Products at Smithfield and Climax Adult Products at Kilburn.
SA Police allege officers seized a total of 800 DVDs, and 45 magazines, depicting sexual or otherwise adult content that did not meet Australian classification standards.
Under Commonwealth law, material depicting acts that would be classified with an X-rating may not be sold anywhere other than Canberra and the NT.
Such material may also not be offered for rental, nor exhibited publicly.
On Tuesday, Casey Isaacs, for the trio, asked for time to consider the materials and take instructions from his clients.
The matter was adjourned to a further hearing in January.
