A man accused of raping a woman near a popular city nightclub has learned his fate in court.

A man accused of raping a woman in an alleyway alongside a Hindley Street nightclub has been acquitted of the crime.

After four hours of deliberating on Friday, a jury found Shane Anthony Gray, 23, not guilty of one count of rape by majority.

During the trial, Mr Gray claimed the sexual intercourse with the alleged victim in the alleyway next to the Dog and Duck nightclub on Hindley St was consensual.

Prosecutors had argued that Mr Gray met the alleged victim in the early hours of the morning at the Dog and Duck in the Adelaide CBD in April 2022.

The prosecutor said Mr Gray and the woman were drinking and chatting before they had consensual sex in the disabled toilet – which Mr Gray paid the woman for.

Security then knocked on the door and evicted the duo from the venue.

The jury heard Mr Gray then took the alleged victim around the corner of an alcove near the TAFE car park and had sex with her again.

“During that episode of penile-vaginal intercourse, it hurt, she told him to stop but he didn’t until he had finished,” the prosecutor said.

In a video played to the court of Mr Gray’s arrest shown by a body worn camera, he told an officer he went up to the alleged victim in the nightclub and asked if she wanted to f**k.

“I wanted a root because I’ve been bricklaying six days a week,” he said.

“I’ve been working so hard, guys release their hormones – that’s what they wanna do.”

An evidently intoxicated Mr Gray told the officer the alleged victim had agreed to have sex with him for money.

Mr Gray however argued he had only had sex with the woman until she told him to stop.

The jury foreperson on Friday afternoon told the court that a unanimous verdict had not been made, but a majority of 10 or more jurors had found him not guilty.
